Further, the Society has already issued No Objection to MR/MRS. ­­­­­­________________   for sale of said flat, who, accordingly, have sold his/her/their flat No.____ to MR/MRS. ______________ vide Agreement Dated ________, duly registered before the Sub-Registrar office of ___________ under No._______ (herein after referred to as the “Sale agreement”).
                        
The Society confirms that Mr/Mrs. __________ has already been admitted as members of the society and the share certificate No.___ is transferred in his/her/their name.

2. That the total consideration for this transaction is Rs._____/- (Rupees __________ Only) towards sale of above flat as per the Agreement of Sale dated ______.

3. The society has not issued any NOC to the occupant of the said flat for mortgaging the said flat with any financial institution/Bank for availing any loan/credit facility.

3. The Society has issued NOC dated ______ in favour of ________ Bank for availing loan/credit facility. Therefore, the title to the above flat shall be clear, marketable and free from all encumbrances and doubts, subject to closure of the said loan.

4. The Society confirms that, the Society have NO OBJECTION of whatsoever nature to the said MR/MRS.______________, at their own costs, charges, risks and consequences mortgaging the said flat No.____ with STATE BANK OF INDIA (herein after referred to as “the Bank”) as security for the amount advanced by the Bank to them subject to the due and proper performance and compliances of all the terms and conditions of the sale document by the said MR/MRS.____________.

5.  The Society has not borrowed from any financial institution for the purchase /development of the property and have not created and will not create any encumbrances on the flat allotted to the said Mr/Mrs.___________ (purchasers) during the currency of the loan sanctioned/to be sanctioned by the Bank to them subject to the due and proper performance and compliances of all the terms and conditions of the sale document by the said purchasers.

6. After creation of proper charge/mortgage and after receipt of the copies there of and after receipt of proper nomination in favour of the Bank, from the said purchasers, we are agreeable to accept State Bank of India as a nominee of the above named purchaser/s for the property described above and once the nomination favoring the Bank has been registered in the Society’s register and advice sent to the Bank of having done so, We confirm not to change the same without the written NOC of the Bank.

proper performance and compliances of all the terms and conditions of the
Allotment Letter/Sale Agreement dated _________(herein after referred to as
the “Sale document”)

4. I/We confirm that I/we have no objection whatsoever to the said purchasers,
at their own costs, charges, risks and consequences mortgaging the said
property to STATE BANK OF INDIA ( herein after referred to as “the Bank”) as
security for the amount advanced by the Bank to them subject to the due and
proper performance and compliances of all the terms and conditions of the sale
document by the said purchasers.

5. We have borrowed from _____________________(name of the financial
institution) whose NOC for this transaction is enclosed herewith /
We have not borrowed from any financial institution for the purchase
/development of the property and have not created and will not create any
encumbrances on the property allotted to the said purchasers during the
currency of the loan sanctioned/to be sanctioned by the Bank to them subject to
the due and proper performance and compliances of all the terms and
conditions of the sale document by the said purchasers.

6. After creation of proper charge/mortgage and after receipt of the copies
there of and after receipt of proper nomination in favour of the Bank, from the
said purchasers, we are agreeable to accept State Bank of India as a nominee of
the above named purchaser for the property described above and once the
nomination favouring the Bank has been registered and advice sent to the Bank
of having done so, I/We note not to change the same without the written NOC
of the Bank.

7. After creation of charge/mortgage and after receipt of the copies thereof and
after receipt of the proper nomination in favour of the Bank, from the above
named purchaser , I/We undertake to inform the society about the Bank’s
charge on the said flat as and when the society is formed.

8. Please note that the payment for this transaction should be made by crossed
cheque/Trasfer of funds favouring “______________________________________

_________________________”.

9. In case of cancellation of the sale-agreement for any reason, I/We shall
refund the amount by crossed cheque favouring the Bank A/C

5.We have not borrowed from any financial Institution for purchase of land or construction of building  and have not created and will not create any encumbrances on the flat/house allotted to him/her/them during the currency of the loan sanctioned/to be sanctioned by the bank to him/her/them.
6.We are agreeable to accept State Bank of India as anominee for the flat/house
Allotted to shri/smt_________________________________________and once the nominations favouring the Bank has been registeredand advice sent to the Bank of having done so,we note not to change the same without the written consent of the Bank.
7.We Undertake to inform the Society about Bank’s charge on the said flat as and when the society formed.
